1. Who we are

This website, fromearthtohair.com, is operated by From Earth to Hair LLC, a limited liability company with its business address at 5815 Buchanan St., Hollywood, FL 33021, United States. "From Earth to Hair" is a brand operated by that company.

By accessing this site or placing an order you agree to these Terms, together with our Refund and Return Policy, Shipping Policy and Privacy Policy, which are incorporated by reference.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order.

3. Products, colour results and intended use

Our products are cosmetics for external use on hair and scalp. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease.

Plant-based colour does not lighten hair. It deposits pigment on top of your existing colour. The result depends on your starting shade, hair porosity, the proportion of grey hair, prior chemical treatments and application time. The same product will give different results on different people. Product photographs, swatches and any shade tool on this site are illustrative and are not a guarantee of outcome.

4. Pricing, availability and errors

All prices are in US dollars and exclude applicable taxes and shipping unless stated. Prices and availability may change without notice.

We try to describe products accurately, but we do not warrant that descriptions, images or other content are error-free. If an item is listed at an incorrect price or with incorrect information, we may cancel the order and refund you in full, whether or not the order has been confirmed.

5. Orders and acceptance

Your order is an offer to buy. Our confirmation email acknowledges receipt; it does not constitute acceptance. The contract is formed when we dispatch the items. We may refuse or cancel any order, including for suspected fraud, resale, or quantity limits.

6. Payment

Payment is taken at checkout through our payment providers. You warrant that you are authorised to use the payment method entered.

7. Intellectual property

All content on this site — text, images, logos, product photography and the "From Earth to Hair" name and marks — is owned by us or our licensors and may not be reproduced or used commercially without written permission.

8. Acceptable use

You may not use this site to break the law, interfere with its operation or security, scrape it by automated means, or submit content that is unlawful, defamatory or infringing.

9. Disclaimers

The site and its content are provided "as is". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to your purchase is limited to the amount you paid for the products giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages.

11. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the site or products.

12. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. The state and federal courts located in Florida shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

13. Changes

We may update these Terms. The version in force is the one published on this page at the time of your order.
